Re: the Road Access or R.O.W problem.

Without taking sides on this, it appears that the obvious thing now for Cliffs Resources to sit down with KWG and try seriously to negotiate an easement or Right-of-Way (RoW) deal. This would no doubt add some annual costs to the road plan—result?

The need for a road would depend a lot on the mining/town site plan. No doubt it could be Extended at someone’s cost to some F.N villages or towns. This may also be true of rail.

I don’t know what other conditions KWG may have. They no doubt would want Cliff Resources to agree to ship ore via rail—excluding rail breakdown periods. This negotiations may not be insurmountable; it might even require KWG to review their proposed rail construction techniques, to build off the track as it is extended, as in the old days.

It should not be essential for Cliffs to buy out KWG to resolve this conflict as suggested in one of the articles, or for Cliffs to appeal the decision—but they may to deliberately try once more and delay the project again.

If serious negotiations between the two don’t start almost immediately, the Minister of Development and Mines should precipitate and Chair at least the kick-off negotiations.

    • I don’t know – I understand business is business, but reading the Mining Commissioner’s decision, there appears to be history/bad blood to be overcome.

      Time will tell ….
